Someone in your organization needs to own AI vendor governance. Right now, almost nobody does. The Pentagon just proved what happens when that role doesn’t exist. On May 1, 2026, the Department of Defense awarded classified AI contracts to seven companies: OpenAI, Google, Microsoft, AWS, Nvidia, SpaceX, and Reflection AI. Anthropic was excluded. The reason had nothing to do with technical capability. Anthropic insisted the Pentagon include safety guardrails limiting AI use in autonomous weapons and mass surveillance. The procurement team had no framework for evaluating that position. So they skipped it. Specifically, limits on autonomous weapons systems and mass surveillance applications. The Pentagon’s procurement process had no mechanism to evaluate those terms against operational needs. There was no role, no rubric, no decision framework for weighing a vendor’s safety position as an operational variable.

So the contracts went to vendors who didn’t raise the issue.

Anthropic sued. A federal judge blocked the government’s action, ruling the exclusion was procedurally flawed. The Pentagon awarded the contracts anyway. The White House later reopened discussions after Anthropic unveiled Mythos, its classified cybersecurity tool. But the damage was already visible. The Gap Is Not Unique to the Pentagon

The other 73% are evaluating AI vendors the same way they evaluate cloud storage or CRM platforms. Feature lists, pricing, integration support, uptime SLAs.

That worked when software was deterministic. You bought a tool, it did what it did, and the risk profile was static. AI vendors are different. Their models change behavior between versions. Their acceptable use policies vary wildly. Their safety positions affect what your team can and can’t build. And none of that shows up on a standard procurement scorecard.

The Pentagon’s mistake was treating Anthropic’s safety terms as an obstacle instead of a variable that required evaluation. Most enterprises are making the same mistake at smaller scale. They’re choosing AI vendors based on benchmarks and pricing without asking what constraints the vendor places on use, how those constraints affect planned workflows, and whether those constraints are acceptable given the organization’s risk tolerance.

Who Should Own This

This is an operations role. Not legal. Not IT. Not compliance. Those teams all contribute inputs. But the person who owns AI vendor governance needs to understand the business, sit in procurement conversations, and have a direct line to whoever owns risk.

In practice, this means someone who can answer three questions for every AI vendor relationship:

  1. What does this vendor allow and restrict, and how does that map to our intended use cases?
  2. When the vendor updates its model or policies, who in our organization gets notified and who decides whether we’re still in bounds?
  3. If the vendor’s safety position conflicts with a business need, what’s the escalation path?

Most companies today can’t answer any of these. The Pentagon couldn’t either.

The title matters less than the authority. Call it Head of AI Vendor Governance. Call it VP of AI Operations. Whatever you call it, the person needs procurement influence, operational context, and a direct line to whoever owns enterprise risk. Without all three, the role is decorative.

The Real Risk of Skipping This

Here’s what happens when nobody owns vendor governance. Your team picks the AI vendor with the best demo. Six months later, that vendor updates its acceptable use policy. Your production workflow now violates the new terms. Nobody notices until a customer audit or a compliance review surfaces the gap. Now you’re migrating models under pressure, retraining workflows, and explaining to the board why a vendor policy change disrupted operations.

Or worse. You pick a vendor specifically because it doesn’t have restrictive safety terms. You build systems that depend on that permissiveness. Then regulation arrives. The EU AI Act, NIST frameworks, state-level restrictions. Your vendor has no safety infrastructure to help you comply. You’ve optimized for flexibility and inherited fragility.

The Pentagon chose vendors who didn’t push back on safety. That felt like the easier path in May 2026. It may not feel that way when congressional oversight committees start asking why DoD systems lack the safety guardrails that the excluded vendor tried to include.

An Honest Framework for Vendor Safety Evaluation

You don’t need a 50-page policy document. You need four things:

A vendor safety inventory. For every AI vendor in your stack, document what their current acceptable use policy says, what model behaviors are restricted, and what happens when policies change. Update it quarterly.

A use-case mapping. Match your actual and planned AI workflows against vendor restrictions. Identify conflicts before they become production incidents.

A named owner. One person who is accountable for maintaining the inventory, flagging conflicts, and escalating decisions. Not a committee. A person.

An escalation path. When a vendor’s safety position conflicts with a business objective, who decides? Document that decision tree before you need it.

This is unglamorous work. It will never make a keynote slide. But the absence of it is exactly what led the Pentagon to exclude the one vendor that was trying to build in operational safeguards.

What the Pentagon Story Actually Means for You

The Pentagon’s exclusion of Anthropic will be debated in national security circles for years. But the operational lesson lands everywhere. Every organization buying AI is making vendor governance decisions. Most are making them by default, without a framework, without an owner, without even recognizing that a decision is being made.

The vendor you choose shapes what you can build. The safety terms you accept or ignore determine your risk exposure. The governance role you leave unfilled guarantees that nobody is watching when the terms change.

The Pentagon had a $2 billion procurement process and still couldn’t evaluate a vendor’s safety position. Your procurement process is smaller, but the structural gap is identical. Fill the role. Build the framework. Do it before the decision gets made for you by a vendor update, a regulatory shift, or an incident that nobody saw coming because nobody was looking.
